Introduction and Acceptance of Terms

Welcome to Photoreal AI. By accessing or using the service, you agree to these Terms of Service. If you do not agree, do not use the service.

Service Description

Photoreal AI provides workflows for text-to-image generation, image-to-image transformation, reference-guided editing, prompt-based refinement, and related export or download features. Certain features may require an account, credits, a paid plan, or a supported payment method.

User Accounts and Registration

Account creation: Some features require an account. You must provide accurate and current information.
Security: You are responsible for safeguarding your account credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.
Eligibility: You must be legally able to enter into these Terms under the laws of your jurisdiction.

Content and Intellectual Property Rights

Your content: You retain ownership of the prompts, uploads, reference images, and other content you submit, to the extent permitted by law. You grant us a limited license to host, process, store, reproduce, and transmit that content only as needed to operate the service.
Outputs: As between you and us, you may use outputs generated for your account, subject to applicable law, these Terms, and any third-party rights that may apply.
No model training on your content: We do not use your content to train models.
Our rights: The service, interface, branding, software, and related intellectual property are owned by us or our licensors. You may not copy, resell, sublicense, reverse engineer, or misuse the service except as allowed by law.

Credits, Plans, and Payments

Credit-based usage: Certain generations or edits consume credits. Usage may vary depending on the workflow, model, or selected settings.
Paid features: Some features require a paid plan, credit purchase, or active billing method.
Payment processing: Payments are processed by Stripe or other designated providers. By making a purchase, you authorize the applicable charge.
Pricing changes: We may update pricing, credit costs, plans, or included usage from time to time. Changes apply prospectively unless otherwise stated.
Refunds: Except where required by law, fees are non-refundable.

Generation credit settlement: Credits are reserved before paid generation. Once a generation provider confirms a stage succeeded, that stage remains charged even if its output is blocked by our safety review or cannot be delivered because of a later processing, storage, display, or download error. Unsubmitted stages and stages confirmed failed or canceled are refunded. An unknown provider outcome remains pending until verified. A one-stage expansion costs 4 credits; a two-stage expansion reserves 8 credits and settles each stage separately at 4 credits. These rules apply to new generation tasks; they do not retroactively charge old tasks.

Prohibited Activities

Illegal activity or violation of others’ rights.
Uploading or generating content that is infringing, obscene, exploitative, or otherwise prohibited by law.
Harassment, abuse, unsafe uses, or content involving harm to minors.
Uploading content you do not have the right to use.
Scraping, reverse engineering, distributing malware, automating abuse, spamming, or attempting to bypass technical limits or security controls.
Misrepresenting outputs as non-AI-generated where disclosure is required by law, contract, or platform policy.

Privacy and Data Collection

Our collection and use of personal data are described in the Privacy Policy. By using Photoreal AI, you acknowledge that prompts, uploads, reference images, outputs, billing metadata, and service usage information may be processed as described there.

Availability and Product Changes

We may modify, suspend, or discontinue any feature, workflow, model option, or part of the service at any time.
We do not guarantee that any specific model, setting, output style, or feature will always remain available.
AI outputs may vary over time due to model behavior, prompt differences, reference inputs, or system changes.

Termination

We may suspend or terminate access to Photoreal AI for violations of these Terms, legal risk, suspected fraud, nonpayment, abuse, or security concerns. You may stop using the service at any time. Clauses that by nature should survive termination will survive, including those related to ownership, disclaimers, limits of liability, and indemnification.

Disclaimer of Warranties

The service is provided on an “as is” and “as available” basis. AI-generated outputs may be inaccurate, incomplete, inconsistent, offensive, or unsuitable for your intended use. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service during the three (3) months before the event giving rise to the claim.
